These Terms and Conditions govern the use of Windholm's website and the booking of charter services. By making a booking or using our website, you agree to these terms. Please read them carefully before confirming a reservation.

References to "Windholm", "we", "our", or "us" mean Windholm, operating at 94/1 Rawai Beach Road, Mueang Phuket, Phuket 83130, Thailand.

1. Acceptance of Terms

By submitting an enquiry, confirming a booking, or making a payment, you confirm that you have read, understood, and accepted these Terms and Conditions in full. If you are booking on behalf of a group, you confirm that you have the authority to accept these terms on behalf of all guests in the party.

2. Bookings

All charters are subject to availability. An enquiry does not constitute a confirmed booking. A booking is confirmed only when:

We reserve the right to decline any booking at our discretion without obligation to provide a reason. If we are unable to fulfil a confirmed booking, we will offer an alternative date or a full refund of any amounts paid.

All bookings should be made in advance where possible. Walk-in and same-day bookings are accommodated when available but cannot always be confirmed.

3. Payment

A deposit of 30% of the total charter fee is required to confirm a booking. The remaining balance is due no later than seven days before the charter departure date.

For bookings made within seven days of departure, full payment is required at the time of confirmation.

We accept payment by bank transfer and major credit or debit cards. All prices are quoted in Thai Baht (฿). Currency conversion charges, where applicable, are the responsibility of the guest.

Prices for multi-day charters are quoted per day and include all meals, fuel, park entry permits, and crew. Additional optional services may carry a separate charge and will be communicated clearly before departure.

4. Cancellation Policy

We understand that plans change. Our cancellation terms are designed to be fair while reflecting the operational commitments we make when a charter is confirmed.

Cancellations must be submitted in writing to [email protected]. The date of receipt of written notice determines which tier applies.

We strongly recommend that guests take out travel insurance that covers cancellation costs.

5. Charter Operation

All charters depart from Rawai Beach, Phuket, unless otherwise agreed in writing. Guests are expected to arrive at the departure point at least 15 minutes before the scheduled time.

The Captain has full authority over vessel operations and the safety of all persons onboard at all times. Decisions regarding the route, speed, anchorage, and any aspect of the voyage are at the Captain's sole discretion.

Itineraries described on our website are indicative. Actual routes may be adjusted based on sea conditions, weather, guest preferences, and vessel requirements.

Maximum guest capacity is determined by the vessel's safety certification. We will not exceed this limit under any circumstances.

6. Guest Responsibilities

Guests are expected to:

We reserve the right to refuse boarding to any guest who appears to be under the influence of alcohol or drugs to a degree that poses a safety concern, or whose behaviour is deemed a risk to others. In such cases, no refund will be issued.

Guests are responsible for any damage caused to the vessel or its equipment through wilful or negligent actions. The cost of repairs or replacement may be claimed from the responsible party.

7. Weather, Safety & Force Majeure

We operate in a marine environment where conditions can change. The safety of guests and crew is our highest consideration.

If the Captain determines that weather or sea conditions make a departure unsafe, the charter may be postponed or the itinerary modified. Where a charter cannot take place due to conditions outside our control, we will offer a full rescheduled date or a refund of the charter fee paid.

Force majeure events — including severe weather, natural disasters, government-mandated closures, or other circumstances beyond our reasonable control — may require us to alter or cancel a charter at short notice. In these circumstances, we will endeavour to offer an alternative date. Refunds for force majeure cancellations are at our discretion and will be handled on a case-by-case basis.

8. Limitation of Liability

Windholm carries appropriate vessel insurance and takes reasonable precautions to ensure the safety of all guests. However, participation in maritime activities involves inherent risks.

To the fullest extent permitted by applicable law, we are not liable for any loss, injury, illness, or damage suffered by guests arising from participation in activities during a charter, including but not limited to snorkelling, kayaking, paddleboarding, and swimming.

We are not liable for any loss of personal belongings, including valuables, equipment, or electronic devices brought onboard. Guests are encouraged to leave valuables ashore or secure them appropriately.

Nothing in these terms limits our liability for death or personal injury caused by our own negligence, or for any other liability that cannot be excluded by law.

9. Guest Insurance

Guests are strongly advised to arrange comprehensive travel insurance prior to their charter, including coverage for medical evacuation, personal accident, cancellation, and loss of personal belongings. We do not provide personal insurance on behalf of guests.

10. Photography and Media

Guests are welcome to take photographs and videos for personal use during the charter. We occasionally photograph or film charters for use on our website and social channels. If you prefer not to appear in any media we produce, please let us know before departure and we will respect that preference.

By remaining silent on this matter, guests provide passive consent for incidental appearance in photos or footage taken for promotional purposes. We will never identify guests by name without explicit permission.

11. Intellectual Property

All content on our website — including text, images, logos, and design elements — is the property of Windholm or its licensors. You may not reproduce, distribute, or use our content without written permission.

12. Governing Law

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising from or in connection with a booking shall be subject to the jurisdiction of the Thai courts, unless otherwise agreed in writing.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. The current version will always be available on our website. For confirmed bookings, the terms in force at the time of booking apply unless we have expressly communicated an update and you have accepted it.
